It might not be the best time for selling, but it pays to make sure your real estate agent is doing their job. Read on for how to spot a bad real estate agent.

When selling a house: 

• Be wary of a lack of confidence. Is your real estate agent just nodding along to all your expectations or has he/she provided solid advice on correct pricing for your property in current market conditions? If an agent doesn’t seem to be on top of his/ her game, look for a new one. • Look out for poor communication. Your agent should get in touch regularly, even when there is no new interest in your property. • Make sure your agent is using all available resources. Especially if nobody has come to see your house, find out where and how your property has been listed. From websites to newspapers, check to find out where and how your home is advertised to potential buyers. If an agent isn’t using every tool at their disposal to promote your property, they’re not doing their job. • Check that your agent is working on good presentation. First impressions are everything. A good real estate agent will make sure to take good, clear photos, using correct angles and a good camera. • Professionals aren’t pushy. It’s good to have a real estate agent who is confident and capable, but he/she should never ignore your needs or push you into making decisions.

When buying a house:

• The property should speak, not your real estate agent. Bad real estate agents will try to talk away what you’re actually seeing, especially when the properties don’t match your requirements. • If you feel you’re being pressured in any particular direction, whether it’s a different kind of property or a price tag beyond your budget, that’s a red flag that you should look for a new real estate agent. • The relationship with your real estate agent doesn’t end when the contract is signed. On the contrary, that’s just the beginning. Bad real estate agents will just take their commission and walk away when the transaction is officially completed, but after sales service is crucial. A good real estate agent will follow up to make sure you are satisfied and will assist in arranging technicians and other professionals you may need. This above-and-beyond level of service shows commitment to customer service and sets great agents apart, giving you the confidence to recommend them to others and ensuring you will want to use their services again in the future.

Μόνο οι ιδιοκτήτες των διαμερισμάτων, (και κατόπιν συμφωνίας), μπορούν να χρησιμοποιούν τον χώρο στάθμευσης στην πιλοτή, σύμφωνα με απόφαση του Πρωτομελούς Πρωτοδικείου Αθηνών (απόφαση υπ’ αριθμόν 255/2018).

Χρηματικό πρόστιμο και κράτηση, θα μπορεί να επιβληθεί σε μη κάτοικο της πολυκατοικίας, ο οποίος έχει αποκτήσει θέση πάρκινγκ με συμβολαιογραφική πράξη, και αφήνει το αυτοκίνητό του στους χώρους της πιλοτής.

Η απόφαση του Πολυμελούς Πρωτοδικείου της Αθήνας είναι άμεσα εκτελεστή, ενώ σε αυτήν υπογραμμίζεται χαρακτηριστικά ότι σε καμία περίπτωση δεν μπορεί να παραχωρηθεί εγκύρως η αποκλειστική χρήση στάθμευσης αυτοκινήτου της πιλοτής, εφόσον η ίδια η προσφεύγουσα, αν και κάτοχος διαμερίσματος, στερείται χώρου για να παρκάρει το αυτοκίνητό της. Μάλιστα, το δικαστήριο απειλεί τους τρεις εκ των τεσσάρων κατόχων θέσεων στάθμευσης (σε βάρος των οποίων στρεφόταν η αγωγή) με χρηματική ποινή 1.000 ευρώ και προσωπική κράτηση ενός μηνός για κάθε παράβαση της απόφασης.

Η προσφυγή ιδιοκτήτριας

Η υπόθεση έφτασε στη Δικαιοσύνη μετά από προσφυγή ιδιοκτήτριας διαμερίσματος και αποθήκης σε πολυκατοικία της Αθήνας. Η προσφεύγουσα, επικαλέστηκε ότι με προγενέστερη δικαστική απόφαση είχε κριθεί ότι «οι θέσεις στάθμευσης της πιλοτής αποτελούν αυτοτελείς οριζόντιες ιδιοκτησίες, διότι ο χώρος της πιλοτής ή ανοικτά τμήματα του χώρου αυτού δεν είναι δυνατόν να αποτελέσουν αντικείμενο διαιρεμένης ιδιοκτησίας και, συνεπώς, οι χώροι της πιλοτής ανήκουν στα κοινόκτητα μέρη της οικοδομής».

Επιπλέον, με την αγωγή της, η προσφεύγουσα επικαλούνταν ότι στην προκειμένη περίπτωση οι συμβολαιογραφικές πράξεις δεν μπορούν να ισχύσουν όσον αφορά την αποκλειστική χρήση των επίδικων θέσεων στάθμευσης στους εναγόμενους, διότι δεν έχουν στην κυριότητά τους άλλη οριζόντια ιδιοκτησία, διαμέρισμα ή αποθήκη για να έχουν δικαίωμα χρήσης στις κοινόκτητες θέσεις. Οσον αφορά στο τέταρτο άτομο, σε βάρος του οποίου στρεφόταν η αγωγή, είχε στην κυριότητά του μόνο την αποθήκη του υπογείου, που αποτελεί βοηθητικό χώρο. Οπως τόνιζε η προσφεύγουσα, ούτε σε αυτήν την περίπτωση μπορούσε να παραχωρηθεί εγκύρως η αποκλειστική χρήση θέσης στάθμευσης αυτοκινήτου της πιλοτής, εφόσον η ίδια, αν και ιδιοκτήτρια διαμερίσματος, δεν διέθετε θέση στάθμευσης.

Με αυτό το σκεπτικό, προηγούμενο δικαστήριο είχε ακυρώσει αμετάκλητα τα συμβόλαια μεταβίβασης των θέσεων στάθμευσης στους τρεις πρώτους εναγόμενους. Με την προσφυγή της στη Δικαιοσύνη, η ιδιοκτήτρια ζητούσε τόσο την επιβολή προστίμου όσο και την προσωπική κράτηση των τριών κατόχων των θέσεων στάθμευσης.

Το Πολυμελές Πρωτοδικείο της Αθήνας έκρινε ότι από το σύνολο του αποδεικτικού υλικού, στο οποίο συμπεριλαμβάνονται φωτογραφίες και μαρτυρικές καταθέσεις, καταδεικνύεται ότι οι εν λόγω ιδιοκτήτες κάνουν χρήση των θέσεων στάθμευσης, παρά το γεγονός ότι ήδη έχει κριθεί αμετακλήτως ότι τα συμβόλαια κυριότητάς τους είναι άκυρα. Συνεπώς, η αγωγή της ιδιοκτήτριας πρέπει να γίνει δεκτή, καθώς και να υποχρεωθούν να παύσουν να σταθμεύουν τα οχήματά τους στην πιλοτή της συγκεκριμένης πολυκατοικίας, καθώς και να παραλείπουν τη στάθμευση αυτών στο μέλλον. Σε περίπτωση που δεν σεβαστούν την απόφαση, το δικαστήριο όρισε ότι θα τους επιβληθεί χρηματική ποινή 1.000 ευρώ και προσωπική κράτηση ενός μηνός για κάθε παράβαση της απόφασης, δηλαδή για κάθε φορά που θα παρκάρουν στην πιλοτή!

The truth is that nowadays  it’s usually not about how to maximize the profit, but how to avoid or minimize the loss. And since it’s only natural to value what is ours and overestimate its worth, let a professional weigh in with an objective expert option.

While you should leave the “heavy lifting” to an experienced professional, here are some tips you can do yourself to improve the impression your property makes on potential buyers.

1.Keep pets outside (in the garden or on the balcony) when showing the property, and make sure to clean away any mess, including pet hair and the litter box. It seems obvious, but, a lot of people forget.

2.Remember that less, really, can be more! Get rid of clutter, to make to make your property appear larger and more appealing.

3.Delight all five senses to make sure your property makes the right impression. Buyers may not be concious of it, but smells and sounds that evoke positive associations can influence their decision. Go for pleasant neutral smells and don’t forget to grease those hinges!

4.Factor in the time of day. Select a time when your property looks at its best, with natural light flattering the space.

2.Hire a professional! Your real estate agent’s commission is money well spent, as it’s their job to maximize the potential of your property.

3.Don’t hold off too long on selling in hope that market condtitions might change and you might get a better price. Remember that such changes will affect all properties, not only yours. So while the value of your property might go up, so will the value of the property you’ll be buying next.

4.Selling a property, especially a home, can feel tough, but it’s important to just make that decision and get on with it. The longer you stall, the harder (and costlier) you’re making it on yourself.

5.To get the best results, find a realtor capable of doing a great job of displaying your property on the market.

6.And of course, why not give your real estate agent an incentive (such as a bonus on their commission) to go the extra mile, prioritize your property and sell it within your timeframe.

Καθορίζεται η διαδικασία επιβολής και απόδοσης του φόρου διαμονής, ο τύπος και το περιεχόμενο της δήλωσης απόδοσης του φόρου αυτού, καθώς και το περιεχόμενο, η διαδικασία και ο τρόπος έκδοσης του «ειδικού στοιχείου – απόδειξης είσπραξης φόρου διαμονής», σύμφωνα με τις διατάξεις του άρθρου 53 του ν. 4389/2016 (94 Α΄), όπως ισχύουν.

1. Επιβάλλεται υπέρ του Δημοσίου φόρος διαμονής σε κύρια ξενοδοχειακά καταλύματα της υποπερ. αα της περ. α. της παρ. 2 του άρθρου 1 του ν. 4276/2014 (155 Α΄) και ενοικιαζόμενα επιπλωμένα δωμάτια -διαμερίσματα της υποπερ. γγ΄ της περ. β΄ της παρ. 2 του ίδιου ως άνω άρθρου και νόμου, ο οποίος βαρύνει τον διαμένοντα που έκανε χρήση αυτών. 

Ο φόρος αυτός επιβάλλεται από τις ως άνω επιχειρήσεις με την έκδοση «ειδικού στοιχείου – απόδειξης είσπραξης φόρου διαμονής», το οποίο εκδίδεται πάντοτε προς τον χρήστη του δωματίου ή του διαμερίσματος, μετά την διαμονή του σε αυτό και πριν την αναχώρηση του. Ο φόρος αποδίδεται από τις ως άνω επιχειρήσεις στη φορολογική διοίκηση με μηνιαίες δηλώσεις, οι οποίες υποβάλλονται μέχρι την τελευταία ημέρα του επόμενου μήνα από αυτόν της έκδοσης του «ειδικού στοιχείου – απόδειξης είσπραξης φόρου διαμονής».

2. Το «ειδικό στοιχείο – απόδειξη είσπραξης φόρου διαμονής» περιλαμβάνεικατ’ ελάχιστον τα εξής στοιχεία: ημερομηνία έκδοσης, επωνυμία, διεύθυνση και ΑΦΜ της εκδούσας επιχείρησης, ονοματεπώνυμο διαμένοντα προς τον οποίο εκδίδεται, ημερομηνίες που αφορά η διαμονή και το συνολικό ποσό φόρου διαμονής καθώς και τον αριθμό και την ημερομηνία του παραστατικού πώλησης (απόδειξη, τιμολόγιο) που εκδόθηκε για τη συγκεκριμένη παροχή υπηρεσιών.

3. Το «ειδικό στοιχείο – απόδειξη είσπραξης φόρου διαμονής» εκδίδεται προς τον διαμένοντα στο δωμάτιο ή διαμέρισμα ή, σε περίπτωση περισσότερων διαμενόντων στο ίδιο δωμάτιο ή διαμέρισμα, σε έναν εξ αυτών. Το «ειδικό στοιχείο απόδειξη είσπραξης φόρου διαμονής» δύναται να εκδίδεται και συγκεντρωτικά, όταν ο φόρος διαμονής αφορά τη χρήση περισσότερων του ενός δωματίων ή διαμερισμάτων και το παραστατικό πώλησης (απόδειξη, τιμολόγιο) για τη συγκεκριμένη παροχή υπηρεσιών εκδίδεται για το σύνολο των δωματίων ή διαμερισμάτων προς έναν εκ των διαμενόντων ή προς τρίτο.

4. Το «ειδικό στοιχείο – απόδειξη είσπραξης φόρου διαμονής» δεν επιβαρύνεται με φόρο προστιθέμενης αξίας. 

5. Ο φόρος διαμονής δεν επιβάλλεται σε περίπτωση δωρεάν παροχής υπηρεσιών διαμονής. 

6. Ο φόρος που εισπράττεται κατά την προαναφερόμενη διαδικασία εισάγεται στον Κωδικό Αριθμό Εσόδου (Κ.Α.Ε.) «1392».

7. Η επιβολή των κυρώσεων σε περίπτωση εκπρόθεσμης, ανακριβούς ή μη υποβολής της δήλωσης απόδοσης του φόρου διαμονής καθώς και γενικά η διαδικασία βεβαίωσης και είσπραξης του φόρου αυτού διέπονται από τις σχετικές διατάξεις του Κώδικα Φορολογικής Διαδικασίας (ν. 4174/2013), όπως ισχύουν.

8. Οι διατάξεις της παρούσας καταλαμβάνουν τα «ειδικά στοιχεία – αποδείξεις είσπραξης φόρου διαμονής» που εκδίδονται από 1.1.2018 και μετά. 

9. Μέχρι την υποστήριξη της ηλεκτρονικής υποβολής, η δήλωση απόδοσης του φόρου διαμονής υποβάλλεται σε έντυπη μορφή από τις επιχειρήσειςυπόχρεα πρόσωπα της παραγράφου 1 της παρούσας, στην αρμόδια Δ.Ο.Υ. φορολογίας εισοδήματος σε δυο (2) αντίτυπα, εκ των οποίων το ένα παραμένει στη Δ.Ο.Υ. και το άλλο παραδίδεται στον υπόχρεο.
